The following Terms and Conditions apply to the 'Win a Guitar for Dollars for Collars' Competition. Entry into this competition is deemed acceptance of these Terms and Conditions by each entrant.
1 Promoter
1.1 The Promoter of this Competition is WSPA Australia Limited ACN 083 297 027 of 1/2 Northcote Street, St Leonards, New South Wales, 2065.
2 Conditions of Entry
2.1 It is a term of this competition that entrants adhere to the terms and conditions located on Dollars for Collars website, /terms-conditions (Website Terms and Conditions). Where there is any inconsistency between these Terms and Conditions and the Website Terms and Conditions, the Website Terms and Conditions will prevail.
2.2 Individuals resident in any jurisdiction where the Competition may be in breach of any law are ineligible to enter. The Promoter makes no representation or warranty that the Competition is lawful under the laws of any jurisdiction outside of Australia. Entrants are responsible for making their own enquiries about the lawfulness of the Competition under the laws of their home jurisdiction. By entering the Competition, entrants located outside of Australia represent and warrant that entry and/or acceptance of any Prize will not cause the Promoter to breach any applicable law of any jurisdiction outside of Australia, and indemnify the Promoter against any loss, damage, liability and expense which the Promoter may suffer or incur arising out of or in connection with a breach of this representation and warranty.
2.3 Any entrants who purchase the "Virtual Collar" from the www.dollarsforcollars.org.au website after the commencement of the Promotional Period are eligible.
2.4 Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter into this competition.
2.5 To enter, entrants must purchase a "Virtual Collar" from the www.dollarsforcollars.org.au website during the Promotion Period and follow the prompts to the competition entry page where they will need to input the Entrant details including their first name, last name, email address, residential address and phone number and agree to the terms and conditions, and an answer to the question "Tell us in 25 words or less why dogs mean the world to you" (Competition Question) and submit the fully completed entry form during the Promotional Period. Entry will be automatic upon submission.
2.6 Multiple entries per entrant are permitted, subject to the following:
2.6.1 each entry must follow the purchase of a "Virtual Collar";
2.6.2 each answer to the Competition Question must be substantially unique; and
2.6.3 each entry must be submitted separately and in accordance with entry requirements.
2.7 Incomplete, indecipherable or incomprehensible entries will be deemed invalid as determined by the judges' and Promoter. No correspondence will be entered into.
2.8 The Promoter reserves the right to disqualify any entry where it reasonably suspects the entrant does not comply with the Terms and Conditions, any relevant law, or is otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into. Entries that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually orientated, racially offensive, contain objectionable content or are otherwise inappropriate will not be deemed valid and rejected.
3 Promotion Period
3.1 Promotion commences at 8am AEST on 16th November 2011 and closes at 5pm AEST on 15th February 2012 ("Promotional Period"). The times are subject to daylight savings time.
4 Prize
4.1 There is one (1) first prize and two (2) second prizes to be won.
4.2 First Prize
4.2.1 First prize is an Epiphone Les Paul Studio Guitar signed by musicians Daniel Johns and Chris Cheney.
4.2.2 The recommended retail price of the prize is $700.
4.2.3 The Prize is donated by the Gibson Foundation.
4.3 Second Prize
4.3.1 Second prize is a coffee table book "Music" by Andrew Zuckerman signed by Daniel Johns and a Chris Cheney will sign The Living End Merchandise pack which contains a signed copy of Guitar Australia Magazine (Chris on the cover), signed The Ending is Just the Beginning Repeating album, signed The Living End T-Shirt, The Living End iPhone 4 cover, The Living End stickers and The Living End badges.
4.3.2 The recommended retail price of the prizes is $220.4.4 The prizes cannot be exchanged, transferred or redeemed for cash. The recommended retail value is as provided by the supplier and is correct at time of printing.
4.5 If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
5 How to Win
5.1 Each entry in respect of the competition question will be judged based on originality and creativity by a panel of judges or judge appointed by the Promoter. This is a game of skill, and chance plays no part in determining the winner. The judging will take place at the offices of WSPA Australia, 1/2 Northcote Street, St Leonards NSW 2065 on 29th February 2012 AEST.
5.2 The best entry in relation to the Competition Question, as determined by the judges, will win the First Prize.
5.3 The second best entry to the Competition Question, as determined by the judges, will win the Second Prize.
5.4 Judges' decisions are final and no correspondence will be entered into.
6 Notification
6.1 The prize winner will be notified by telephone or email.
6.2 The Prizes may be collected from the offices of WSPA Australia, 1/2 Northcote Street, St Leonards, NSW 2065 at a time stipulated by the Promoter.
6.3 If for any reason a winner does not collect a prize by the time and date stipulated by the Promoter, then the prize will be forfeited.
6.4 Should the winner of any prize not claim the prize, or the Promoter is unable to locate a winner of the major or runner-up prizes by the time stipulated by the Promoter, the prize will be forfeited by the winner(s), with no liability whatsoever on the Promoter towards the prize winner(s).
6.5 The Promoter reserves the right to conduct further judging after the time stipulated by the Promoter, at a time to be determined by the Promoter and at the same place as the original judging in order to distribute any prizes that remain unclaimed by that date.
7 Miscellaneous
7.1 Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
7.2 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) the operation or use of any prize.
7.3 The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.
7.4 Any and all costs associated with collecting the prize (including but not limited to shipping, postage, storage, airfares, transport, accommodation and meals) are the sole responsibility of the entrant.
7.5 The Promoter reserves the right to request the winner to provide proof of identity at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
